P Penelitian ini dilatarbelakangi oleh sengketa merek antara Rohto Pharmaceutical, CO., LTD. dengan Komisi Banding Merek, permasalahan tersebut disebabkan penolakan merek DERMACEPT dari Rohto Pharmaceutical, CO., LTD sebab memiliki kesamaan pada pokoknya dengan merek DERMASEP.Dalam Skripsi ini mempertanyakan, apakah asas First-to-File dalam Putusan Pengadilan Niaga Nomor 60/Pdt.Sus-HKI/Merek/2023/PN. Niaga.Jkt.Pst telah sesuai dengan Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis serta pertimbangan Majelis Hakim dalam putusan tersebut telah mencerminkan kepatuhan terhadap prinsip relative ground for refusal of registration. Metode yang digunakan adalah yuridis normatif dengan sifat deskriptif. Data diperoleh dari data sekunder yang dianalisis secara kualitatif melalui studi pustaka dan kesimpulannya ditarik secara deduktif. Berdasarkan hasil analisis, penelitian ini menyimpulkan bahwa penerapan asas First-to-File dan prinsip relative ground for refusal of registration dalam putusan tersebut telah sesuai dengan ketentuan yang diatur dalam Pasal 3 dan Pasal 21 Undang-Undang Nomor 20 Tahun 2016.
T This research is motivated by a trademark dispute between Rohto Pharmaceutical, CO., LTD. and the Trademark Appeal Commission, specifically regarding the rejection of the DERMACEPT trademark by Rohto Pharmaceutical, CO., LTD. due to its substantial similarity with the DERMASEP trademark. This research questions whether the First-to-File principle in the Commercial Court Decision Number 60/Pdt.Sus-HKI/Merek/2023/PN. Niaga.Jkt.Pst is in accordance with Law Number 20 of 2016 concerning Trademarks and Geographical Indications, and whether the panel of judges\\\' considerations in the decision reflect compliance with the principle of relative grounds for refusal of registration. The method used is normative juridical with a descriptive nature. Data was obtained from secondary data and analyzed qualitatively through a literature review, with conclusions drawn deductively. Based on the analysis, this study concludes that the application of the First-to-File principle and the principle of relative grounds for refusal of registration in the decision is in accordance with the provisions stipulated in Articles 3 and 21 of Law Number 20 of 2016.
