P Perkembangan teknologi digital telah mengubah cara konsumsi musik secara global, termasuk di indonesia dan amerika serikat. lagu kini tidak hanya digunakan sebagai media hiburan, tetapi juga sebagai aset ekonomi yang dapat dimonetisasi melalui berbagai platform digital. sayangnya, kemudahan ini juga memicu meningkatnya pelanggaran hak cipta seperti pembajakan dan penyalahgunaan performing rights. dalam konteks ini, royalti atas performing rights menjadi krusial sebagai bentuk perlindungan dan penghargaan terhadap pencipta lagu. penelitian ini mengkaji dua rumusan masalah, yaitu bagaimana persamaan dan perbedaan sistem pengaturan royalti performing rights antara indonesia dan amerika serikat, serta sejauh mana sistem amerika serikat dapat diadopsi dalam kerangka hukum indonesia. metode penelitian yang digunakan adalah normatif dengan pendekatan perbandingan hukum melalui studi literatur terhadap regulasi, kelembagaan, dan praktik pengelolaan hak cipta di kedua negara. hasil penelitian menunjukkan bahwa sistem di amerika serikat lebih matang, terstruktur, dan didukung oleh regulasi khusus seperti u.s. copyright act 2020, dpra (digital performing right act), dan dmca (digital millenium copyright act), serta lembaga profesional seperti ascap (american society of composers, authors and publishers), bmi (broadcas music inc), dan soundexchange, sementara indonesia masih menghadapi tantangan implementasi di lapangan seperti keterbatasan pelacakan, rendahnya transparansi, dan minimnya kesadaran hukum. penelitian ini menyarankan agar indonesia melakukan reformasi hukum dan kelembagaan melalui pembentukan lmk (lembaga manjemen kolektif) digital, modernisasi teknologi pelacakan, serta pendirian lembaga independen penetapan tarif royalti sebagaimana praktik di amerika serikat, di samping meningkatkan edukasi publik guna menjamin sistem royalti yang lebih adil, akurat, dan adaptif terhadap perkembangan era digital..

T The development of digital technology has changed the way music is consumed globally, including in indonesia and the united states. songs are now used not only as a medium of entertainment, but also as an economic asset that can be monetized through various digital platforms. unfortunately, this convenience has also triggered an increase in copyright violations such as piracy and misuse of performing rights. in this context, royalties on performing rights have become crucial as a form of protection and appreciation for songwriters. this study examines two research questions: the similarities and differences between the performing rights royalty regulation systems in indonesia and the united states, and the extent to which the united states system can be adopted within the indonesian legal framework. the research method used is a normative one with a comparative legal approach through a literature study of regulations, institutions, and copyright management practices in both countries. the results show that the system in the united states is more mature, structured, and supported by specific regulations such as the u.s. copyright act. copyright act 2020, dpra (digital performing rights act), and dmca (digital millennium copyright act), as well as professional institutions such as ascap (american society of composers, authors and publishers), bmi (broadcast music inc), and soundexchange, while indonesia still faces implementation challenges in the field such as limited tracking, low transparency, and minimal legal awareness. this study recommends that indonesia undertake legal and institutional reforms through the establishment of a digital collective management institution (lmk), modernization of tracking technology, and the establishment of an independent institution for setting royalty rates as is the practice in the united states, in addition to increasing public education to ensure a fairer, more accurate, and more adaptive royalty system to the development of the digital era.
