Kepemilikan hak atas tanah dan pembatasannya terhadap orang asing di Malaysia
H Hak kepemilikan atas tanah merupakan hubungan hukum kepemilikan yang secara hakiki dijunjung tinggi keberadaannya dan mendapat perlindungan dari Negara. Bagaimanakah pengaturan jenis kepemilikan hak-hak atas tanah, bagaimanakah pengaturan pembatasan pemilikan hak atas tanah terhadap orang asing di Malaysia, menjadi pokok permasalahan yang dianalisis. Penelitian ini bertipe penelitian hukum normatif, bersifat descriptif, dianalisis secara kualitatif, kesimpulan digunakan pola pikir deduktif. Sistem hukum Kerajaan Malaysia bersumber pada Common Law. Pemilikan tanah dan bangunan berasaskan Natrekking (Perlekatan). Jenis hak atas tanah terdiri dari Freehold Title, Leasehold Title, Malay Resereve Land, Buputera Lot. Terdapat pembatasan pemilikan hak atas tanah terhadap orang asing. Orang asing dapat memiliki segala jenis properti di Malaysia selama persyaratan yang ditetapkan oleh otoritas Negara Bagian dipenuhi, kecuali untuk (1) Properti bernilai kurang dari RM1 juta, (2) Unit perumahan harga rendah dan menengah, (3) Properti terletak di Malay Reserved Land, (4) Properti yang diperuntukan bagi Bumiputera dalam proyek pengembangan properti.
L Land ownership rights are a legal relationship of ownership which is essentially upheld and protected by the State. How is the arrangement of the types of ownership of land rights, how are the restrictions on the ownership of land rights to foreigners in Malaysia, the main problems analyzed. This research is a normative legal research type, is descriptive in nature, analyzed qualitatively, and uses a deductive mindset. The legal system of the Kingdom of Malaysia is based on Common Law. Ownership of land and buildings is based on Natrekking (attachment). Types of land rights consist of Freehold Title, Leasehold Title, Malay Reserve Land, Buputera Lot. There are restrictions on the ownership of land rights to foreigners. Foreigners can own any type of property in Malaysia as long as the requirements set by the State authorities are met, except for (1) Property worth less than RM1 million, (2) Low and medium priced residential units, (3) Property located in Malay Reserved Land , (4) Property intended for Bumiputera in a property development project.
