Kebencian terhadap ras Asia di Amerika Serikat pada saat pandemi covid-19 ditinjau dari hukum hak asasi manusia internasional
F Fenomena kejahatan kemanusiaan terhadap ras Asia di berbagai wilayah di dunia, termasuk di Amerika Serikat pada saat Pandemi Covid-19 menimbulkan kekhawatiran dalam konteks perlindungan kelompok minoritas dan pengurangan bias rasial. Berbagai kasus-kasus kejahatan rasial yang melibatkan ras Asia yang menjadi korban kekerasan dan berakibatkan luka berat hingga kehilangan nyawa. Pokok permasalahan yang dibahas yaitu apa saja bentuk-bentuk pelanggaran hak asasi manusia terhadap ras Asia pada saat Pandemi Covid-19 dan bagaimana upaya pemerintah Amerika Serikat terhadap kasus kebencian terhadap Ras Asia ditinjau dari Hukum Hak Asasi Manusia Internasional seperti ICCPR dan The Civil Rights Act. Metode penelitian yang digunakan adalah penelitian normative bersifat deskriptif analitis dengan sumber data primer, sekunder, dan tersier di analisis dengan metode kualitatif dan menghasilkan kesimpulan deduktif. Diskriminasi rasial dan serangan terhadap ras Asia ini merugikan hak untuk hidup dan keamanan individu. Untuk itu pemerintah Amerika Serikat bertindak dalam penegakan prinsip-prinsip Hak Asasi Manusia Internasional yakni peningkatan penegakan hokum terhadap kejahatan rasial, alokasi dana bagi pemulihan korban kekerasan, dan pembentukan satuan tugas khusus untuk menangkal xenophobia terhadap warga Asia.
T The phenomenon of crimes against humanity against the Asian race in various regions of the world, including in the United States during the Covid-19 pandemic, raises concerns in the context of protecting minority groups and reducing racial bias. Various cases of hate crimes involving Asians were victims of violence and resulted in serious injuries and even loss of life. The main issues discussed were what forms of human rights violations against the Asian race during the Covid-19 pandemic and how the United States government's efforts to deal with cases of hatred against the Asian race were reviewed from international human rights law such as the ICCPR and the Civil Rights Act. The research method used is normative research which is descriptive analytical in nature with primary, secondary and tertiary data sources analyzed using qualitative methods and producing deductive conclusions. This racial discrimination and attacks against the Asian race harm individual rights to life and security. For this reason, the United States government is acting in upholding the principles of International Human Rights, namely increasing law enforcement against hate crimes, allocating funds for the recovery of victims of violence, and establishing a special task force to counter xenophobia against Asians.
